Subscription Terms of Service

Contracting Party: Macan Trading, trading as Smart Storage, registered in the Netherlands.

By creating an account, subscribing, or using our services, you agree to these Terms. If you don’t agree, you may not use the service.



1. Who We Are


Smart Storage is the trading name of Macan Trading. We provide subscription-based software to help storage companies manage operations.



2. Eligibility & Accounts


You must be at least 18, have the authority to agree to these Terms, and provide accurate information. Keep your login details secure — you’re responsible for activity on your account.



3. Plans & Payments


All subscriptions are billed in advance. Prices are shown on our website (exclusive of VAT unless stated). We may update prices, but will give at least 30 days’ notice. Payment is due on the date shown on your invoice. Late or failed payments may result in suspension.



4. Using Smart Storage


You may use our service only for lawful purposes and in accordance with its intended use. Don’t copy, resell, or interfere with the platform.



5. Integrations & Third Parties


Some features connect with third-party services. We’re not responsible for their actions, terms, or policies.



6. Data Protection & Privacy


We follow the EU General Data Protection Regulation (GDPR). We process personal data only as needed to provide our services. For more details, see our Privacy Policy.



7. Intellectual Property


All rights in our software, branding, and materials remain with us or our licensors. You’re granted a limited, non-exclusive, non-transferable licence to use the service during your subscription.



8. Availability & Maintenance


We aim for 99.7% uptime per year, excluding planned maintenance, events outside our control, malicious attacks, or issues caused by your own systems. See Schedule 1 for support levels.



9. Ending Your Subscription


You can end your subscription at the end of your current billing period by giving 30 days’ written notice. We may end your subscription immediately if you breach these Terms or fail to pay.



10. Limitation of Liability


We’re not liable for indirect or consequential loss. Our total liability in any 12-month period is capped at the total subscription fees you paid in that period. Nothing limits liability for death, personal injury, fraud, or anything that cannot be excluded by law.



11. Changes to These Terms


We may update these Terms from time to time. We’ll notify you of significant changes at least 30 days before they take effect. Continued use of the service means you accept the changes.



12. Assignment


You may not transfer your rights or obligations under these Terms without our written consent. We may transfer or subcontract our rights or obligations at any time.



13. Third Party Rights


These Terms are between you and us only. No one else can enforce them.



14. No Partnership or Agency


Nothing in these Terms creates a partnership, joint venture, or agency relationship between us.



15. Notices


Formal notices must be in writing and delivered by hand or email. For Smart Storage: hello@smartstorage.com. For you: any email linked to your account. Email notices are considered received when sent unless bounced.



16. Counterparts


These Terms may be agreed to electronically. Your online acceptance is legally binding.



17. Governing Law & Jurisdiction


These Terms and any disputes will be governed by Dutch law. The courts of the Netherlands will have exclusive jurisdiction.



Schedule 1 – Support & Service Levels


Definitions — Key terms include “Fault” (a serious failure of the service), “Maintenance Release” (a software update), “New Version” (major upgrade), and “Out-of-Scope Support” (issues caused by you or outside our control).

Minimal business impact.

Acknowledge within 3 business days, fix in next update.

System Availability — We aim for 99.7% uptime/year, excluding scheduled downtime, force majeure, malicious attacks, or your own system issues. If we miss this, you may request a credit up to your annual subscription fee.

Custom Development — Extra features are outside the standard service and require a separate agreement.

Browser Support — We support the latest versions of major browsers; older browsers may not work as intended.


Execution — By using Smart Storage, you confirm you have read, understood, and agree to these Terms.
